Product liability cases arise when manufacturers, distributors, suppliers, retailers and others who make products available to the public are held responsible for the injuries those products cause. These types of cases are usually based on:

design defects
manufacturing defects
a failure to warn of potential hazards

A mass tort is when many people are injured by a similar product and file suit against one or more corporate defendants. In the United States, these lawsuits take place in state or federal court systems. A mass tort usually arises when:

there are many people injured by the same drug or medical device ;
there is a large-scale disaster where many people are injured, such as in a plane crash;
people are unknowingly or unwillingly exposed to a hazardous substance, such as radiation; and
there are many instances of injury from a similar defective product, such as a lawn mower or other consumer product.
