Augmentin Antitrust Litigation

In Ryan-House v. GlaxoSmithKline PLC, filed in the Eastern District of Virginia, RODANAST, P.C. filed the only direct purchaser class action alleging that GSK violated Section 2 of the Sherman Act by unlawfully maintaining its monopoly over the antibiotic Augmentin and its generic equivalents.  Specifically, it was alleged that GSK misled the United States Patent and Trademark Office into issuing invalid patents that purportedly protected Augmentin and that the existence of those invalid patents prevented generic manufacturers from bringing less expensive generic versions of Augmentin to market.  As a result, class members paid more for Augmentin than they would have in the absence of the alleged anticompetitive conduct. RODANAST, P.C. settled the case for $62.5 million.
